Oregon Court Says Group Can Challenge Compact’s Constitutionality

Opponents of the Three Rivers Casino in Florence have a right to challenge the constitutionality of the compact that allowed the casino to be built in 2004, the Oregon Supreme Court ruled last week. The casino operated by the Coos, Lower Umpqua & Siuslaw Indians isn’t the only one at risk if the legal challenge bears fruit.

A federal judge has denied California Governor Arnold Schwarzenegger’s request for a delay of a case that, if it goes against him, will allow the Rincon tribe in San Diego County to deploy the full 2,000 slot machines that its compact authorizes, something the governor has been trying to stop.

The Massachusetts tribe that wants to build a casino in Middleboro has decided that the agreement it negotiated three years ago with developers Sol Kerzner and Len Wolman gives the investors too much and the tribe too little. The Mashpee Wampanoag tribe wants to renegotiate.

Indian casinos in the Golden State are weathering the recession much better than commercial casinos in Las Vegas. Last year California’s casino revenues fell 5.6 percent, compared to 10 percent for Las Vegas.

A lawsuit by the Flandreau Santee Sioux Tribe of South Dakota against the state has hit a brick wall due to arguments over what may be admitted in evidence. The tribe claims that former Governor Bill Janklow’s administration negotiated its tribal state gaming compact in bad faith.
