To create a fund to help sports teams, Italy lawmakers tacked an additional tax against Betfair and other sportsbooks. Betfair filed a suit too challenge inclusion and calculation process. They won the latter.

Italian lawmakers produced a Save Sports Fund in early 2020 to help deal with the coronavirus pandemic’s negative impact on sports of all sorts. During 2020 and 2021, all betting licensees will pay an additional 0.5 percent of money collected on wagers, including sportsbooks and horse racing.

Betfair—and others—challenged the law, asking the Administrative Court of Rome to exclude betting exchanges and to render the calculation flawed, according to CDC Gaming Reports.

The court did not exclude exchanges. But the body did accept the voidance as a result of a lack of information at the outset. According to the Court, the government provided no evidence to explain the calculation for betting exchanges.

The court asked regulators to redraft the implementation notice and to speak to the betting exchanges in doing so. Betting stakeholders’ engagement should be the starting point for fair betting legislation.
