Casino Must Collect Tax On Free Rooms

Mountaineer Casino in New Cumberland, West Virginia recently lost a round in Hancock County Circuit Court where Judge Ronald Wilson ruled the casino must collect the state hotel occupancy tax hotel rooms it provides to gamblers for free. The county claimed it has lost hundreds of thousands of tax revenue dollars.

In West Virginia, Hancock County Circuit Court Judge Ronald Wilson recently ruled Mountaineer Casino, Racetrack & Resort in New Cumberland must collect the state hotel occupancy tax on complimentary rooms.

The decision came in a 2012 lawsuit Hancock County filed against the resort, seeking to force the casino to collect the 6 percent tax on rooms it provides at no charge to gamblers. The lawsuit claimed the county has lost hundreds of thousands of dollars in tax revenue due to the free rooms.

Mountaineer had claimed it does not have to collect tax on the free rooms.

Now Hancock County and Mountaineer must determine how much tax should be collected, along with damages owed.
