CJEU Upholds EC Online Gambling Guidelines

The Court of Justice for the European Union has upheld recommended standards for online gambling released by the European Commission. Belgium challenged the recommendations, which were seen as less thorough than Belgium’s own rules under it gambling act. The country argued that the recommendations were actually an attempt to have unified standards across the EU. The court upheld that the recommendations are just that, and not requirements.

In a case dating to 2014, The Court of Justice for the European Union has upheld recommended standards for online gambling released by the European Commission.

Belgium challenged the recommendations saying that The EC was actually trying to impose regulations on member states. The EC recommendations are seen as being less thorough than Belgium’s own regulations under its gambling act and the country would have to lower its standards to meet them.

The EC recommendations cover advertising standards for online gambling services, health warnings, child protection, age verification, and information guidelines for online gaming operators across the European Union.

The Court, however, ruled that the recommendations are simply non-binding guidelines and refused to annul them.

The EC also ceased involvement with adjudicating online gambling disputes in October.
