Court: Melco Crown Erred in Manila Hire

The Philippine Court of Appeals has ordered Melco Crown to honor a 2014 agreement it made to refrain from hiring employees of Bloomberry Resorts, its rival in Manila’s Entertainment City casino zone.

Fong flipped to Melco within a month

The Philippine Court of Appeals has ordered Melco Crown Entertainment to abide by an agreement to not hire the employees of rival Bloomberry Resorts and Hotels for a minimum of six months after their termination, according to multiple media reports.

The case was sparked by Melco Crown’s hiring of Miles Fong Hio, a former Solaire employee at its parent company Crown Resorts.

In 2013, Fong was hired by Solaire as director for premium and player development, working with junkets who dealt with VIP gamblers. Fong resigned from Solaire in January 2015. He asked for a waiver of the compromise agreement but was denied. Even so, by February he began working for Crown Resorts Ltd. as director of sales operations.

In its case, Bloomberry noted Crown Resort is a parent company of Melco Crown Entertainment Leisure and is thereby covered by the compromise agreement. Melco Crown said the agreement does not cover people employed outside of Philippines and added that it was “impossible to prevent Crown Resorts Ltd. from hiring Fong.”

The Court of Appeals sided with Bloomberry, saying Melco Crown “specifically undertook to bind itself, together with its parent companies and subsidiaries to comply with the provisions of the compromise agreement.”
