The battle between the former Revel Atlantic City and its former energy plant will continue in federal court.
A judge ruled that the dispute between Glenn Straub’s Polo North Country Club Inc. and ACR Energy presents “a maze of allegations” that need to be sorted out in court.
Straub is trying to evict ACR Energy from the site of its power plant, which sits on leased land across the street from the closed casino. Straub bought the land when he acquired the casino in April. Since then he has been battling with ACR over past power bills and looking for a new energy supply for the site.
Chief U.S. District Judge Jerome Simandle said dueling lawsuits between the two entities “present a maze of allegations” that should be worked out in federal court, according to the Press of Atlantic City.
The power company claims Polo North is improperly trying to evict it and acquire the about $40 million in nits equipment. Polo North moved to have the case dismissed, assaying it belonged in state court and not federal court, the Press reported.
