Illinois Casino Agrees To Class Action Settlement

Boyd Gaming, owner of Par-A-Dice Casino (l.) in East Peoria, Illinois, agreed to an $825,000 settlement in a class action lawsuit alleging the casino’s use of facial recognition security cameras violated the state’s biometric Information Privacy Act.

Illinois Casino Agrees To Class Action Settlement

Patrons who passed by certain facial recognition security cameras at the Par-A-Dice Casino’s sportsbook in East Peoria, Illinois between September 2020 and June 2021 have until February 6 to file a claim in the $825,000 settlement of a class action lawsuit claiming the casino violated the state’s Biometric Information Privacy Act.

Plaintiffs said Par-A-Dice used the cameras to collect, store and use unique facial recognition data without patrons’ consent, thereby violating the state’s BIPA law.

The casino denies any wrongdoing but owner Boyd Gaming said it will agree to the settlement to avoid further legal expenses.

Each class member will be entitled to an equal share of the net settlement fund after expenses and fees are deducted. The exact cash payment will depend on the number of participants in the settlement.

The case name is Pruitt, et al. v. Par-A-Dice Hotel Casino, et al., Case No. 2020-L-000003, in the Circuit Court for the Tenth Judicial Circuit of Tazewell County, Illinois. The final hearing is scheduled for February 8.
