Illinois Casino Worker Sues Over Fingerprints

Eldorado Resorts Inc. and Grand Victoria Riverboat Casino in Illinois recently were hit with a class action lawsuit. Casino employee Ronnie Aquino filed the lawsuit in Cook County Circuit Court, claiming the company and their casino violated the Illinois Biometric Information Privacy Act by requiring employees to scan their fingerprints when clocking in and out of their work shifts.

Aquino, who works at the Grand Victoria, said he was regularly required to scan his fingerprints to verify his identity. The lawsuit said Eldorado did not obtain written authorization from employees for the fingerprint scans and did not provide notices as allegedly required under the BIPA law.

The plaintiff is seeking statutory damages of $1,000 to $5,000 per violation, plus attorneys’ fees and other relief.
