Kansas Approves Fantasy Sports Bill

The Kansas legislature has approved a bill declaring fantasy sports a game of skill and making playing fantasy sites legal in the state. State gaming regulators had ruled that fantasy sports was a game of chance, which would mean fantasy sports could only be administered as part of the state-run lottery.

Playing fantasy sports is now legal in Kansas after the state legislature approved a bill declaring that fantasy sports are a game of skill.

Gaming regulators in the state had previously ruled that fantasy sports are a game of chance and operate as an illegal lottery. Under the state constitution, games of chance must be administered by the state under its broad definition of a lottery.

State Attorney General Derek Schmidt, however, released an opinion in April saying legislators could legalize fantasy sports leagues by declaring that the outcomes depend upon the knowledge and skill of the players.

The House approved the bill on a 98-21 vote Thursday. The Senate approved it Monday, 37-1, and the bill now goes to Republican Governor Sam Brownback. The governor has not said whether he will sign the bill.
