Malta Creates Regulations for Skill Games

The Malta Gaming Authority has implemented a new regulation governing skill-based games, and has determined that fantasy sports now fall into the skill-game category.

The Malta Gaming Authority (MGA) announced the implementation of its new Skill Games Regulations, and has indicated that fantasy sports are governed by the regulation under the category of “controlled skill games.”

The Skill Games Regulations (S.L. 438.11) are now in force following publication in the Government Gazette on January 24. The regulations are designed to ensure consumer protection, fairness of the game, and the prevention of criminality.

Furthermore, skill games which, in the opinion of the MGA, should be subject to additional regulatory supervision because of any additional risk they may pose to consumers, may, by virtue of a public ruling issued by the MGA, will be deemed “controlled skill games,” and thus require a special controlled skill game license. DraftKings has already been awarded a license under the regulation for daily fantasy sports.
