New Jersey Releases Affiliate Guidelines

The New Jersey Division of Gaming Enforcement has released guidelines for affiliate sites that drive traffic to the state’s online gambling sites. Affiliates must be licensed in either of two categories.

The New Jersey Division of Gaming Enforcement has released updated guidelines for the licensing of online gaming affiliates that drive traffic to online gambling sites.

Affiliates that are paid a flat fee to direct traffic to a website must apply for vendor registration. Sites that receive a percentage of money wagered or deposited must be licensed as an ancillary casino service industry enterprise.

The new rules cover flat fees for banner clicks to sponsorships.

The ancillary CSIE classification covers cost per action where affiliates are paid based on action tied to a variable such as the amount a payer deposits or bets. That also includes revenue sharing for coded users.

The rules also cover sub-affiliates working with a “master affiliate” that has an agreement with the online gambling site. The sub-affiliate must also be licensed.

All compensation must be based on the contract the affiliate submits to the DGE for review.
