New Mexico Racino License Still Up In Air

A court challenge by a disgruntled applicant has kept the New Mexico Racing Commission from awarding the state’s fifth and final racino license since December. The board wasn’t expected to move on the license until the challenge is addressed although it was on the agenda for last week’s meeting.

The fifth and final New Mexico racino license is still up in the air because of a challenge in the courts that have made the racing commission reluctant to go forward with the process for awarding it.

The New Mexico Racing Commission was scheduled to meet last week, and although the license was on the agenda, no one expected any action at that meeting.

The issue that has stopped the license being issue is a challenge by one of the five applicants for the license, Hidalgo Downs LLC, which accuses the commission of not studying the issue sufficiently to make a decision. Its purpose is to prevent the commission from using a study that it commissioned in making its decision.

The study did not paint the Hidalgo Downs proposal in a positive light.
