Regulators Put Conditions on Wynn Boston Development

The Massachusetts Gaming Commission has held that the mixed-use development planned by Wynn Resorts will be considered outside its purview as part of the official gaming establishment, as long as the project meets seven conditions.

The first phased of the development, across the street from Wynn’s Encore Boston Harbor resort, is planned to include 20,000 square feet of restaurant space, a 999-seat live entertainment venue, a 2,200-space parking garage, and a 400-foot pedestrian bridge connecting the complex to the casino hotel. Later proposed development includes two hotels, a brew pub and other amenities.

The regulators’ conditions include submission of security plans for the pedestrian bridge and parking garage, a prohibition on employees of the development having access to restricted casino areas, a requirement for Wynn to submit plans for any future developments in advance, and that the proposed development submit to review under the Massachusetts Environmental Policy Act. Other conditions address questions concerning the live entertainment venue and rules for event space to be leased to third parties.

“We are agreeable to all the conditions as set forth in this meeting,” Jacqui Krum, Encore Boston Harbor’s senior vice president and general counsel, told the commission, according to WHDH News 7 Boston. “After the conditions had been approved and the decision was made not to incorporate the development into the casino’s technical gaming footprint, we’ll be back in front of you shortly with plans.”
