Appeal Delays California Casino Construction

The Enterprise of Rancheria Maidu in Northern California has temporarily stopped construction of the Enterprise Rancheria Fire Mountain Casino in response to an appeal to California’s 3rd District Court of Appeal, by a rival gaming tribe.

A tribe near Sacramento, California is continuing its legal action to try to stop the Enterprise Rancheria Fire Mountain Casino from opening, and has managed to delay construction for now, at least.

The United Auburn Indian Community of the Auburn Rancheria has filed an appeal with California’s 3rd District Court of Appeal to prevent the Enterprise of Rancheria Maidu from continuing the construction that it began several months ago near Marysville. The Auburn tribe operates Thunder Valley Casino Resort nearby. Both are in Yuba County.

John Mayer, the attorney for the Maidu told the Northern California Record: “The tribes with competitive gaming facilities are bringing litigation towards the Enterprise Rancheria tribe to slow the construction process down.” As a result, he said, the tribe may be forced to suspend construction.

Fire Mountain Casino would be located on “off-reservation” land, i.e. land that was not reservation land before 1988, the year that the Indian Gaming Regulatory Act (IGRA) was adopted. The Maidu tribe was required to go through the “two-part” determination that also included approval by California Governor Jerry Brown.
