California Casino Co-Owner Seeks to Clear his Name

The part owner of a casino in San Jose, California is challenging an administrative law judge’s findings that he tried to hide profits of the Casino M8trix. At stake is his gaming license, and says Eric Swallow (l.), his reputation.

Judge Mary-Margaret Anderson has recommended that the state take Gambling Control Commission away Swallow’s license and fine him $430,000 for allegedly hiding casino profits and providing fraudulent information.

State regulators tried without success to prove other allegations, which could have led to Swallow paying $18.8 million.

Swallow has already agreed to sell his share of the casino, but says he plans to fight the charges. His erstwhile partners, Peter and Jeanine Lundardi, were accused of hiding casino profits to avoid paying taxes. They settled their case with the state and kept their license while Swallow, who hasn’t settled, is in jeopardy of losing his.

One allegation made in the judgment is that Swallow misrepresented his marital status when he applied for a license to operate Hollywood Park. Swallow says he made an “honest mistake.”
