Everi Payments, the fintech arm of Everi Holdings, announced that it has won in a patent lawsuit filed by Sightline Payments over Everi’s CashClub Wallet electronic payment system. Sightline claimed that CashClub Wallet infringed on five of its patents “that allow for cashless transactions used in casino gaming offerings and non-gaming spend.”
The original lawsuit, filed by Sightline late in 2021, was dismissed by the Western District of Texas U.S. District Court. Everi then filed for a review of the patent infringement claims by the U.S. Patent and Trademark Office Patent Trial and Appeals Board. The patent office held for Everi in all five inter-party reviews.
“A patent claim is unpatentable under federal law,” Everi said in a press statement, “if the differences between the claimed subject matter and the prior art are such that the subject matter, as a whole, would have been obvious at the time the invention was made to a person of ordinary skill in the art to which said subject matter pertains.”
Everi’s CashClub Wallet enables cashless funding of gaming through player e-wallets. Over 20 gaming venues have adopted the platform across at least six states.
Everi Chief Legal Officer Kate Lowenhar-Fisher said, “Everi is gratified that after reviewing all of the facts and testimony, the PTAB found in our favor. As with all litigation, there is uncertainty and additional appeals may be forthcoming.”
